This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.815/2016 registered at Police Station- Civil Line, Raipur, District - Raipur (C.G.) for the offence punishable under Section 384/34 of Indian Penal Code.

As per the prosecution case, on 18.12.2016 one Harihar Prasad Dewangan was handed over to exchange the note by Vicky Sankhala of Rs.21,25,000/- at that time one Katare of Police caught hold of him. Thereafter, the applicant roamed around for quite time and extended threat that complainant will lodged inside the jail. Thereafter only Rs.4,10,000/- was given back to Harihar Prasad Dewangan while rest of the amount were taken away. Thereby the offence has been committed.

Learned counsel for the applicant would submit that the applicant has been falsely implicated in this case and the entire allegation is on one Katare and others and there is no evidence against the present applicant, therefore, the the applicant may be released on bail.

Per contra, learned State counsel opposes the prayer for grant of bail and would submit that the applicant may not be released on bail as the investigation is going on.

I have heard learned counsel for the parties. 6.

Considering the nature of allegation made and taking into the fact that investigation is still going on. Taking into the present stage of investigation, I am not inclined to release the applicant on bail. 7.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is dismissed.
