1. Learned counsel for the petitioner submits that while the petitioner was working on the post of Inspector in Police Station Baloda, Distt. Janjgir Champa a charge sheet was issued to him. After concluding the departmental enquiry, vide order dated 27.06.2017 he was imposed punishment of stoppage of one increment in his salary with cumulative effect. Against such order, the petitioner had preferred departmental appeal (Annexure P-3) on 08.11.2019 before the Director General of Police, Respondent No.2

2. Learned counsel for the petitioner submits that though the appeal was filed

long back on 08.11.2019 yet the same is pending before respondent No.2, therefore, he prays that for the time being a direction may be issued to decide the departmental appeal within a stipulated period.

3. Learned State Counsel does not object the limited prayer made by the petitioner.

4. Considering the fact that the departmental appeal was already preferred on 08.11.2019 before respondent no.2 against the order imposing punishment passed by the Disciplinary Authority, this Court is of the view that respondent no.2 Director General of Police is obliged to decide the departmental appeal of the petitioner within a further period of 90 days from the date of receipt of copy of this order. It is made clear that this court has not made any observation on merits of the case.
