1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicants in connection with Crime No. 45/2016 registered at Police Station Vishrampuri, Distt. Kondagaon (C.G) for the offence punishable under Sections 294, 323, 506, 364(A)/34 of IPC.

2. As per the prosecution case, on 02.05.2016 a report was made by one Rajesh Sori that on 26.04.2016 the complainant was abducted by the present applicant and other accused and one of the accused demanded Rs.12,35,000/- from the father of complainant and also assaulted.

3. Learned counsel for the applicants would submit that the

story as projected by the prosecution is completely improbable as the complainant who was said to be kidnapped could not have been released without ransom. He further submits that the victim has taken loan from the present applicants and others which shows that there has been some monetary transaction between the victims and applicants and false allegations have been made.

4. Per contra, learned State Counsel opposes the bail.

5. Perused the statement of complainant Rajesh Sori and the father of complainant namely Dhannuram Sori.

6. After perusal of such statements and taking into the facts and circumstances of the case, I am not inclined to allow this bail application. Accordingly, it is rejected. Sd/- GOUTAM BHADURI JUDGE R a o
