1. The applicant has preferred this first bail application under Section 439 of Cr.P.C. as he is in jail since 01.09.2021 in connection with Crime No. 153/2021 registered in Police Station Jamul, District Durg (C.G.), for the offence punishable under Section 34 (2) of the Excise Act.

2. Learned counsel for the State has shown the number of criminal antecedents of the applicant.

3. Learned counsel for the applicant seeks to withdraw this bail application with liberty to file a fresh application as and when occasion arises.

4. Accordingly, the bail application is dismissed as withdrawn with the liberty as stated above.
