The petitioner's application for grant of lease has been rejected by the Collector, Janjgir Champa vide order dated 29.07.2017 against which this writ petition has been preferred by the petitioner. 2.

Learned counsel for the petitioner would submit that the impugned order is unsustainable and bad in law and is liable to be set aside.

Learned State counsel would submit that against the order of Collector representation would lie before the Commissioner as per para 18 of the Revenue Book Circular.

I have heard learned counsel for the parties. 5.

Be that as it may, the petitioner is at liberty to make representation before the Commissioner, Bilaspur Division that will be considered and decided by the said authority, expeditiously, preferably within a period of 45 days from the date of receipt of copy of order after hearing the affected parties. The petitioner would also be at liberty to make an application for stay before that Court.

With the aforesaid direction, the writ petition stands finally disposed of. No cost(s).
