2. G. R. Churendra, the Member and Joint Director, High Level Caste Scrutiny Committee, Adim Jati Anusandhan Avam Prashikshan Sansthan, Government Of Chhattisgarh, Raipur, District- Raipur, Chhattisgarh ---- Respondents For Petitioner Shri Goutam Khetrapal, Advocate Hon'ble Justice Shri Prashant Kumar Mishra Order On Board 09/08/2018 1.
This contempt petition has been preferred alleging contempt of the order passed by this Court on 20.11.2015 in WPC No.7608/2011. For compliance of the said order, the petitioner moved a representation for the first time on 08.01.2018. 2.
Under Section 20 of the Contempt of Courts Act, 1971, the limitation for initiating any proceeding for contempt is one year from the date on which the contempt is alleged to have been committed. In the present case, since there was no period
mentioned in the order dated 20.11.2015 for passing fresh order, the reasonable period for passing such order by the respondents would be 3 months from the said date, therefore, in any case the contempt petition should have been preferred within one year from 20.02.2016.
3.
The contempt petition is hopelessly barred by limitation. It is accordingly dismissed as barred by limitation. Sd/- Prashant Kumar Mishra Judge Nirala
