1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 419/2016 registered at P.S. City Kotwali, Dhamtari, Distt. Dhamtari (C.G) for the offence punishable under Sections 392 of IPC.

2. As per the prosecution case, on 08.11.2016 the applicant along-with other accused has snatched the gold chain of complainant Rukmani Sahu, thereby the offence has been committed.

3. Learned counsel for the applicant would submit that the applicant has been falsely implicated; only on memorandum of co-accused the applicant has been inclupated and no allegations can be attributed against him, therefore, he may be enlarged on bail.

4. Per contra, learned State Counsel opposes the bail.

5. Perused the case diary and the documents.

6. Considering the fact that some part of the snatched gold chain was seized from the present applicant, I am not inclined to allow this bail application. Accordingly, it is rejected.
