Heard on prayer for grant of leave to appeal as indigent person. The plaintiff had originally filed a suit seeking decree of specific performance of contract along with other reliefs based on pleadings of advance payment of about 9 Lakhs and readiness to pay balance amount of Rs.6,50,000/- which the appellant is ready and willing to pay, seeking decree of specific performance. This shows that the appellant's financial condition is sound. The Collector's report has also been perused. Considering the aforesaid material , it is not a fit case for grant of leave to appeal as indigent person. The MCC is therefore, rejected. The appeal be listed for further orders.
