The applicant has preferred this first bail application under Section 439 of the Cr.P.C. for grant of bail as he has been arrested in connection with Crime No.160/2019 registered at Police Station Bodla, District Kabirdham (CG), for the offence under Section 20 (b) of the Narcotics Drugs and Psychotropic Substances Act, 1985.

Applicant along with co-accused Lalit Rajput were found traveling in a vehicle along with 98.110 kgs. Ganja.

Ordinarily I would not have allowed bail to the applicant considering the quantity of ganja recovered from the accused, however, co-accused Lalit Rajput has been granted bail by a coordinate Bench of this Court in MCrC No.352 of 2020 (decided on 27-2-2020) and the case of the present applicant is similar and, in fact, he has remained in jail for a longer period than the co-accused Lalit Rajput, who has been enlarged on bail considering his pre-trial detention period, therefore, I have no other option but to direct release of the present applicant on bail.

Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.1,00,000/- with two local sureties in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
