1. The limited grievance that the petitioner has raised in the present writ petition is the inaction on the part of the respondents No.3&5 in not taking a decision on the claim of the petitioner for compassionate appointment.

2. The facts of the case is that, the Wife of the petitioner was working as Assistant Teacher (P) under the respondents No.3&5 in district Korba and who died in harness on 13.04.2016. The present petitioner, who is the Husband of the petitioner, moved an application for compassionate appointment, but till date no decision as such has been taken by the respondents.

3. The contention of the petitioner is that, the petitioner is a graduate and that if the petitioner is not eligible for appointment as Assistant Teacher (P), the

-2authority may consider the claim of the petitioner for compassionate appointment against a Class-IV post or even as Panchayat Secretary.

4. Given the limited grievance that the petitioner has, this court is of the opinion that no fruitful purpose would be served in keeping this petition pending, rather ends of justice would meet if the writ petition is disposed of with a direction to the respondents No.3&5 to take an early decision on the claim of the petitioner for compassionate appointment at the earliest preferably within a period of four months from the date of receipt of copy of this order.

5. It shall be the responsibility of the petitioner to apprise the respondents No.3&5 so far as order passed by this court is concerned.

6. Accordingly, the writ petition stands disposed of. Sd/- (P. Sam Koshy) Judge inder
