This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.177/2016, registered at Police Station - Ambagarh Chauki, District Rajnandgaon (C.G.) for the offence punishable under Section 420 of IPC.

2. As per the prosecution case, a report was made by complainant Savitri Bai that in the year 2012, the present applicant had obtained Rs.35,000/- for providing job to her daughter as a peon but he did not provide job nor did he return the money and thereby has committed the offence. 3.

Learned counsel for the applicant submits that the incident is of the year 2012 and the report was made in the year 2016 and therefore the applicant has been falsely implicated in this case. Thus, counsel for the applicant prays that the applicant may be enlarged on bail.

On the other hand, learned counsel for the State opposes the bail application on the ground that the applicant had also taken rupees from different persons for providing job and there is a statement of Savitri Bai, Manish and others in this regard who have stated that in similar nature, the applicant had obtained different amount from different persons. 5.

Perused the case diary and the documents.

Considering the total facts and circumstances of the case, particularly the number of such allegations attibuted to the present applicant, I am not inclined to release the applicant on bail at this juncture. 7.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is dismissed.
