Versus

State Of Chhattisgarh Through Officer-in-Charge of Police Station Kamleshwarpur, District- Sarguja (CG) ---- Non-Applicant For Applicant : Shri Malay Jain, Advocate.

For Non-Applicant : Shri Arjit Tiwari, Panel Lawyer. Hon'ble Shri Prashant Kumar Mishra, Ag CJ Order On Board 04/10/2021 :

1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.34/2021 registered in Police Station Kamleshwarpur, District Sarguja for offence under Section 457 & 380 of the IPC.

2. This is the 2nd bail application on behalf of the applicant.

3. The applicant has committed theft of one Honda Activa Scooter, one computer laptop, one gold chain, one gold ring, 14 bank passbooks and 3 cheques from the house of complainant Kelsangh.

4. Learned State Counsel would oppose the prayer for grant of bail on submission that the applicant has two previous antecedents of committing similar nature of crime.

5. Considering that the applicant is in jail since 21.5.2021; charge sheet has already been filed and the offences are triable by the Judicial

MCRC No. 6961 of 2021 Magistrate 1st Class, I am inclined to release the applicant on bail on the following conditions:-  the applicant shall execute a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court;

 he shall appear before the trial Court on each and every date given by the said Court;

 he shall appear before the concerned Police Station on First and Fifteenth day of every month between 11 am & 2 pm during the pendency of trial;

 he shall not get involved in any criminal offence during the pendency of trial;

 registration of any criminal case against him would entail automatic withdrawal/cancellation of this bail order and the concerned Police shall be entitled to arrest him forthwith on registration of fresh criminal case against him after informing the trial Magistrate.

6. The application is accordingly allowed.
