1. Heard on application for condonation of delay in filing the appeal.

2. Upon due consideration, the application is allowed. Delay in filing the appeal is condoned.

3. Heard on prayer for grant of leave to appeal.

4. Taking into consideration the submission of learned State Counsel, particularly taking into consideration the submission with regard to evidence as led by the prosecution regarding the criminal overt act of the appellant and his identification by the prosecutrix, we are inclined to grant leave to appeal. Prayer is accordingly allowed.

5. Let the appeal filed by the State be registered as an acquittal appeal and be listed for further orders on the date to be fixed by the Office. Let summons be issued to respondent-accused for his appearance on the date of hearing to be fixed by the Office.

6. CRMP is accordingly disposed off.
