1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 671/2016 registered at P.S. Sarkanda, Distt. Bilaspur (C.G) for the offence punishable under Sections 25 & 27 of the Arms Act.
2. As per the prosecution case, on 01.10.2016 certain information was received that the present applicant is in possession of arms. On receipt of such information, a raid was conducted and from the possession of the applicant one Gupti was recovered and from other accused one country made pistol was recovered, thereby the offence has been committed.
3. Learned counsel for the applicant would submit that the applicant has been falsely implicated and the place of seizure was Murum mines and it is not a case that the applicant was threatening the people at large. He further submits that the charge sheet has been filed and the
applicant is in jail since 01.10.2016, therefore, he may be enlarged on bail.
4. Per contra, learned State Counsel opposes the bail and submits that as many as six other offences of different sections of IPC stands rejected against the applicant.
5. Considering the past antecedents of the applicant, I am not inclined to allow this bail application. Accordingly, it is rejected.
