1. Heard learned State counsel on I.A. No.1, application for condonation of delay in filing the Cr.M.P. as also on admission.
2. On due consideration, delay of 06 days in filing the Cr.M.P. is condoned. Accordingly, I.A. No.1 stands allowed.
3. The trial Court has acquitted the accused of the charge
CRMP No. 1783 of 2019 under Section 302 of IPC.
4. The accused has allegedly committed murder of his wifeJayantri Bai. PW-1, Dharminbai Joshi and PW-3, Maheshwari Joshi, have stated that the deceased and the accused had consumed liquor in their house and there was altercation between them. Later on they moved out of their house together and the deceased was found dead in the next morning.
5. The present is a fit case for grant of leave to appeal. Accordingly, Cr.M.P. is allowed.
6. Let regular acquittal appeal be registered and the same be place for consideration in the next week.
