Hon'ble Shri Justice Goutam Bhaduri Order 03.11.2020 Heard.
1. The grievance of the petitioner is that the Respondent No. 4 who is a handicapped was promoted to the post of Assistant Grade-III and was directed to join at Govt. Middle School, Gaushala Naila, District Janjgir, Champa. It is contended that Respondent No. 4 has however not executed the said order and have submitted an affidavit stating that she is not willing to except the promotion to the post of Assistant Grade -III. Under the circumstances, the petitioner has made a representation to District Education Officer (Respondent No. 3) to cancel the promotion of Respondent No. 4 and prays that the said representation may be decided within a stipulated time.
2. Without any observation on the merits, since the limited prayer has been made to decide the representation of the petitioner, Respondent No. 3 is directed to decide the representation of the petitioner considering the facts and after hearing all the interested parties within a further period of 90 days from the date of receipt of a copy of this order.
3. It is further made clear that this Court has not observed any opinion whether any right is accrued to the petitioner or not. It is only on the request of the petitioner the representation is directed to be decided.
