The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.348/2016 registered in Police Station Chakradhar Nagar, Raigarh (C.G.) for offence punishable under section 304 (B) of Indian Penal Code, 1860.

As per the prosecution case, one Rajkumari died because of burn injury on 17/10/2016. She sustained the burn injury on 16/10/2016. She was married to the present applicant in the year 2013. It is alleged that she was subjected to torture for demand of dowry. Subsequently, she died unnatural death within 7 years of the marriage. 3.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case and omnibus allegations have been levelled against the applicant. He submits that charge sheet has been filed, therefore the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the statement of father of the deceased which was recorded on 17/10/2016 and other statement of witnesses. Considering

the same, without further observation on the merits, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
