The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.325/2015 registered in Police Station Dharsiwan, Distt. Raipur (CG) for offence punishable under sections 399, 402 of Indian Penal Code, 1860. 2.

As per the prosecution case, on 7/10/2015 on an information received that the applicant alongwith other co-accused are making preparation for committing dacoity in Canara Bank ATM, they have gathered in front of SKS Ispat, police party raided and apprehended the applicant.

Learned counsel for the applicant submits that similarly placed coaccused has been enlarged on bail on 7/12/2016 vide M.Cr.C. No.7841 of 2016, therefore he may be released on bail.

Learned State counsel opposes do not dispute the fact that similarly placed co-accused has been enlarged on bail on 7/12/2016 vide M.Cr.C. No.7841 of 2016.

Considering the facts and circumstances of the case and also for the fact that similarly placed co-accused has been enlarged on bail on

7/12/2016 vide M.Cr.C. No.7841 of 2016, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
