(2) After arguing for a fairly long time, learned counsel

appearing for the petitioner submits that the impugned order dated 06.10.2016 (Annexure P/1) passed by Respondent No.3Collector-Balrampur is appealable before the appellate authority and, therefore, he may be permitted to withdraw the instant writ petition with liberty to prefer an appeal before the appellate authority for redressal of his grievance within a period of 10 days from today. To this, counsel for the State has no objection. (3) Prayer appears to be fair and reasonable.

(4) The petitioner is permitted to prefer an appeal before the appellate authority. If such appeal is filed by the petitioner within a period of 10 days from today and, in turn, the appellate authority shall consider and decide the same in accordance with law and on its own merit preferably within a period of 45 days from the date of receipt of appeal of the petitioner along with copy of this order.

(5) With the aforesaid observation, the writ petition stands finally disposed of. No order as to cost(s).
