(2) Learned counsel for the petitioner submits that the petitioner has been suspended vide the impugned order dated 05.10.2016 (Annexure P/1) passed by respondent No.2 without any contemplation of departmental enquiry and during the suspension period, the petitioner has been transferred from Bemetara to Dantewada. Against which, he has made representation before the respondent No.2 i.e. Excise Commissioner, Raipur but till this date no decision has been taken and, therefore, he may be directed to consider and decide the same expeditiously.
(3) Prayer appears to be fair and reasonable.
(4) In view of above, the respondent No.2- Excise Commissioner, Raipur is directed to do well and take a decision on the pending representation filed by the petitioner in accordance with law preferably within a period of three months from the date of receipt of certified copy of this order.
(5) For a period of 15 days, the effect and operation of the impugned transfer order dated 05.10.2016, in respect of the petitioner shall remain stayed.
(6) With the aforesaid observation, the petition stands finally disposed of. No order as to cost(s).
