This petition has been brought being aggrieved by the order dated 23.08.2021, passed by the Judge, Family Court, Ambikapur in Civil Suit No.229-A/2018, whereby the order has been passed allowing the respondent and granting him permission to visit his minor son, who is at present in the custody of the petitioner.

It is submitted by the counsel for the petitioner that because of this order, the respondent is making use of every opportunity available to come and visit minor son and that is causing huge inconvenience to the petitioner, therefore, some day or time duration be fixed for the meeting of the respondent with his son.

Counsel for the respondent does not have any specific objection, however, it is submitted that the respondent is resident of Chhapara, Bihar and has to come on the day on which the case against him is posted, before the Family Court, therefore, order may be passed granting visitation right to the respondent to visit his minor son on the date of hearing after the Court hours.

Considered on the submissions. Considering the same, this petition is disposed off. The impugned order is modified and it is ordered that the respondent shall have liberty to visit his minor son on the day the case pending between the parties is listed in Court any time after Court hours during day time.
