1. Heard.

2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.2/2020 registered at Police Station New Rajendra Nagar, Raipur for the offence punishable under Sections 41 (1 + 4) of Cr.P.C. and 379 of the IPC.

3. The applicant along with co-accused Jatin Talreja and Sumit Bhaka have committed theft of 10 two-wheelers, total valued at Rs.5,20,000/-.

4. Learned counsel for the State would submit that the applicant is also involved in Crime No.214/2020 of P.S. Rajendra Nagar and there are other crimes registered against the applicant.

5. Learned counsel for the applicant submits that in Crime No.214/2020, the applicant has already been released on bail by the trial Court and in this offence also, he has been released on parole. He further submits that from the applicant's possession, 2 two-wheelers i.e. one Activa and one Honda Duet have been recovered, therefore, it is not correct to say that the applicant is involved in commission of theft of 10 two-wheelers.

6. Having considered that the applicant is in jail since 16.9.2020 and the charge sheet has already been filed and in other crimes, he has already been released on bail, I am inclined to release the applicant on regular bail.

7. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his furnishing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
