The applicant has preferred this application for grant of bail as she is arrested in connection with Crime No.609/2016 registered in Police Station Mohan Nagar, Durg, District Durg (C.G.) for offence punishable under sections 3, 4, 5 & 7 of the Prevention of Immoral Traffic Act.

As per the prosecution case, on raid being conducted on 29th November, 2016 while fake customer was appointed, with amount of Rs.200/- customer when went and paid the amount and said amount was recovered from the applicant and the amount was provided on the ground that the applicant is carrying on the trade of prostitution by the other main accused the applicant was found in the said house and different contraceptive and liquor were also seized. 3.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case, charge sheet has been filed, no further investigation would be necessary, applicant is a lady and is in jail since 29/11/2016. He submits that other co-accused has been enlarged on bail

on 31/01/2017 vide M.Cr.C. No.341 of 2017, therefore the applicant may be released on bail.

Learned State counsel do not dispute the fact that other coaccused has been enlarged on bail on 31/01/2017 vide M.Cr.C. No.341 of 2017.

Considering the facts and circumstances of the case, charge sheet has been filed and also for the fact that other co-accused has been enlarged on bail on 31/01/2017 vide M.Cr.C. No.341 of 2017, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on her furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for her regular appearance before it as and when directed.
