At the outset, learned counsel for the applicant prays that instant bail application may be disposed of as withdrawn as the applicant No.2- Krishna Rajwade intends to surrender before the concerned criminal court having jurisdiction on Darima Police Station. He further submits that if he surrenders before the concerned criminal court and files appropriate application under Section 437 Cr.P.C., the same may be heard as expeditiously as possible on the same day as co-accused Karan Ram Rajwade

has already been granted regular bail by this court vide order dated 13.4.2017 in M.Cr.C. No.2387/17.

As prayed, the instant application is disposed of as withdrawn without any appreciation on its merits if the applicant gives three days prior notice to the SHO/IO in relation with Crime No.157/2016, Police station Darima regarding his date of surrender before the concerned criminal court and if the applicant files appropriate application under Section 437 of Cr.P.C., the same may be disposed of as expeditiously as possible on the same day.

Accordingly, the bail application filed under Section 438 of the Cr.P.C. is hereby disposed of.
