1. The applicant has filed this application for grant of anticipatory bail as he is apprehending his arrest in connection with Crime No.2 of 2017 registered at Police Station Jainagar, Distt. Surajpur, for the offence punishable under Sections 419,420,467,468,471 and 120-B IPC.
2. The allegation against the applicant, as per prosecution is that, the applicant in the capacity of Sarpanch of the village, is said to have got muster-roll prepared in respect of two persons namely Mohar Lal and Lalmaen Rajwade who infact had not worked during the relevant period of time and in their place some other person is said to have worked. Later on, the applicant is said to have sent one of his lieutenant Ram Narayan for obtaining signatures from the wife of the Mohar Lal i.e. Lalmaen Rajwade for withdrawal of the money which was credited to
their account in respect of Rozgar Guarantee Yojna.
3. A perusal of case diary would reveal that there is statements of Mohar Lal as well as Lalmaen Rajwade that one Ram Naresh was sent by the applicant for obtaining their signatures on the withdrawal forms. The said amount has already been withdrawn and distributed. Thus, taking into consideration the nature of allegation and specific role attributed by the applicant, this court is of the opinion that it is not a fit case to grant anticipatory bail to the applicant. Accordingly, the bail application is rejected.
