1. Heard on prayer for grant of leave to appeal.

2. After considering the submission of learned State Counsel, particularly taking into consideration the submission with regard to proof of age of the prosecutrix as led by the prosecution before the trial Court, we are inclined to grant leave to appeal. Prayer is accordingly allowed.

3. Let the appeal filed by the State be registered as an acquittal appeal and be listed for further orders on the date to be fixed by the Office. Let summons be issued to respondent-accused for his appearance on the date of hearing to be fixed by the Office.

4. CRMP is accordingly disposed off.
