By means of this Writ Petition, the Petitioner has challenged the Notice Inviting Tender dated 21.10.2016, mainly on the ground that the Petitioner was awarded contract for handling and transportation of all the goods of the FCI at Kharsia by the Chhattisgarh Ware Housing Corporation. 2.
Shri Pillai, learned Counsel appearing for the FCI, on instructions, submits that the tenders for Kharsia floated by FCI have been cancelled because the rates received were on the higher side. Without going into the question as to whether the FCI could have invited the tenders of this station, we are of the view that nothing survives in this Petition. 3.
In view of above,the Writ Petition is accordingly dismissed.

However, liberty is granted to the Petitioner to again approach this Court in case fresh cause of action arises.
