Hon'ble Shri Justice P. Sam Koshy Order on Board 01/12/2020 1.
The contention of the petitioner claiming is that the writ petition has been filed for seeking quashment of the order of suspension dated 27.06.2020 primarily for the reason that no charge-sheet or disciplinary proceeding has been initiated against the petitioner within a period of 90 days from the date of suspension order being issued.
2.
The State counsel submits that considering the totality of the facts and circumstances of the case, the writ petition can be disposed of directing the respondents to take an appropriate decision on the order of suspension at the earliest.
3.
The writ petition accordingly stands disposed of with a direction to the respondents to immediate take an appropriate decision in the case of the suspension of the petitioner particularly taking note of the fact that inspite of the period of 90 days having lapsed the charge-sheet has not been issued to the petitioner and the requirement under the Rules of 1966 warrants issuance of chargesheet within the said stipulated period. Let an appropriate decision be taken within a period of 30 days from the date of receipt of the copy of this order.
4.
With the aforesaid observations, the present writ petition stands disposed of.
