1) First Bail application of the applicant was dismissed as withdrawn by this Court vide order dated 01.03.2021 in MCRC No. 455 of 2021.

2) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973, as he was arrested on 23.11.2020 in connection with Crime No.501/2020 for the offence punishable under Section 302 of IPC, registered at Police Station- Kota, Bilaspur, District- Bilaspur (C.G.).

3) After arguing for sometime, learned counsel appearing for the applicant seeks to withdraw this application with liberty to file afresh as and when occasion arises.

4) Counsel for the State has no objection to the above prayer.

5) Permission granted.

6) Accordingly, the application is dismissed as withdrawn with the liberty as stated above.
