The present is a third application filed under Section 439 of CrPC seeking for grant of bail to the Applicant who is in jail since 10.3.2017 in connection with Crime No. 29/2017 registered at Police Station Narayanpur, District Narayanpur, for the offence punishable under Sections 376, 506 of IPC as well as Sections 4, 6 of POCSO Act. 2.

The earlier two bail applications stood rejected vide orders dated 26.3.2018 and 9.5.2019 respectively. While rejecting the earlier bail application, this Court had granted liberty to the Applicant to revive the bail application after the Prosecutrix is examined. Prosecutrix has since been examined; hence the present application.

Perusal of the statement of the Prosecutrix would show that she had in fact supported the case of the prosecution and, as such, no strong case for grant of bail is made out. The bail application therefore is rejected. 4.

It is made clear that the observations made by this Court in this order or any previous orders while rejecting the bail application of the Applicant would not be construed for deciding the trial on its own merits. 5.
