1. Heard.
2. The order under challenge is an interim order passed by respondent No.2-Collector, Balrampur, in an appeal preferred by respondent No.6 Smt. Manhgi Devi.
3. The petitioner has an option of moving an application for vacating stay before the Collector or to prefer an appeal/revision before the Commissioner under Section 44 of the C.G. Land Revenue Code, 1959. The petitioner instead of availing any of the option has straightway rushed to this Court.
4. At this stage, learned counsel for the petitioner would submit that the petitioner has already appeared before the Collector.
5. If that be so, the petitioner may move fresh application for vacating stay, which shall be considered by the Collector in accordance with law at the earliest.
