The present application has been filed under Section 438 of CrPC for grant of anticipatory bail to the Applicant who is apprehending his arrest in connection with Crime No. 267 of 2016, registered at Police StationCivil Kotwali, District- Jashpur, for the offence punishable under Sections 420, 467, 468, 471, 34 of IPC.

After arguing for some time, learned Counsel for the Applicant prays for withdrawal of the present application, with a direction that in the event if the Applicant moves an application for grant of regular bail before the concerned Court below then the said Court below may decide the said application on the same day.

Accordingly, the present application filed under Section 438 of CrPC is dismissed. However, it is directed that if the Applicant surrenders himself before the concerned Court below and moves an application for grant of regular bail then the same shall be decided by the said Court, if possible, on the same day, on its own merits, in accordance with law.
