This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested on 11.11.2014 in connection with Crime No. 609/2014, registered at Police Station- Supela, District - Durg (C.G.) for the offence punishable under Section 420, 120(B), 467, 468, 471/34 of the Indian Penal Code.

As per prosecution case, in brief, is that the applicant along with other co-accused obtained Rs.82,57,000/- from the 28 persons to provide government employment for them and when the job could not be provided, the report was made, thereby the offence was committed . 3.
Learned counsel for the applicant submits that the applicant has been falsely implicated in this case, charge-sheet has been filed, no further investigation is necessary and the applicant is in jail since 11.11.2014, therefore, he may be enlarged on bail.

On the other hand, learned State counsel opposes the prayer for grant of bail.

I have heard the learned counsel for the parties perused the case diary and the documents.

Taking into consideration the nature of allegations which have been attributed to the applicant, particularly the fact that he has collected more than Rs.82,00,000/- from around 28 persons on the pretext of granting them government employment, this Court is of the view that it is not a fit case where the applicant can be released on bail, at this juncture.

Accordingly, the bail application filed under Section 439 of Cr.P.C. is liable to be and is hereby dismissed.
