Learned counsel appearing for the petitioner would submit that respondent No. 2- Board has rejected the application filed by the petitioner for change of his date of birth in the mark sheet of class Xth on the ground that the said application has been filed by the petitioner after three yeas of declaration of result whereas his application has not been considered and decided on merits.

Be that as it may, the respondent No. 2 - Board is directed to consider and decide the petitioner's application on its own merit in accordance with law expeditiously preferably within a period of 45 days from the date of receipt of certified copy of this order. 4.
