(2) Learned counsel appearing for the petitioner submits that the
petitioner is facing departmental enquiry for which, he has made several representations before the respondent authorities for appointment of defence assistant, which has not been considered and decided by the respondent authorities and, therefore, direction may be issued to decide the same expeditiously.
(3) Prayer appears to be fair and reasonable.
(4) Be that as it may, respondent No.4 i.e. Superintendent of Police, Durg is directed to consider and decide the application of the petitioner for appointment of defence assistant in the light of provision contained in Rule 14(8) of C.G.Civil Services (Classification, Control and Appeal) Rules, 1966 expeditiously from the date of receipt/production of copy of this order (5) It is made clear that this Court has not expressed any opinion on the merits of the case and the respondent authorities may decide the same on its own merits.
(6) With this direction, the writ petition stands disposed of. No order as to cost(s).
