1. Learned counsel for the petitioner submits that though the respondent has been served with notice to appear in the case bearing CS No. 609/2018 (Gurpreet Kaur Vs. Salinder Singh Soni) filed by the petitioner under Order 13 (1) (a) of the Hindu Marriage Act, 1955 pending before the Family Court, Durg, since 24/10/2018, yet learned family Court is not proceeding ex-parte in the absence of the respondent. Petitioner has filed an application (Annexure P-3) for proceeding ex-parte against the respondent.

2. I have heard learned counsel for the petitioner at length and considered his submissions.

3. Learned family Court, Durg is directed to consider the application filed the petitioner on 10/04/2019, for proceeding ex-parte in the absence of the respondent, strictly in accordance with law on the next date of hearing.

4. With the aforesaid direction, this writ petition stands disposed of. No cost(s).

5. A copy of the order be sent to the concerned family Court by e-mail/fax.
