This is the second bail application under Section 439 of Cr.P.C. The earlier bail application was dismissed as withdrawn on 20/07/2021 with liberty to repeat the same after examination of the complainant. 2.

The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.35/2020 registered in Police Station Koni, District Bilaspur (C.G.) for offence punishable under section 392/34 of Indian Penal Code.

As per the prosecution case, on 17/12/2020 while the complainant was going to his village the accused persons stopped him and threw chilli powder and looted Rs.1,63,930/-.

Learned counsel for the applicant submits that the complainant has been examined and he has not supported the case of the prosecution which cannot be rebutted by the State counsel. 5.

Perused the statement of the complainant Vinay Singh. Without further observation on the merit, this court is inclined to release the

applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
