The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.1155/2016 registered in Police Station Supela, District Durg (C.G.) for offence punishable under sections 379, 471, 482, 486, 34 of Indian Penal Code. 2.
As per the prosecution case, a report was made on 20/12/2016 by one Naresh Sharma that his motorcycle bearing No. CG/07/AJ-0342 was stolen from out side Nehru Nagar Garden, Bhilai. Subsequently, one Farookh Rangrej and Jaspal were arrested and on their memorandum it revealed that said motorcycle was sold to the present applicant.

Learned counsel for the applicant submits that only on the memorandum statement of the other co-accused, applicant has been arrested and motorcycle has been seized and he is bonafide purchaser, therefore no offence has been committed and the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail.

Perused the case diary and the documents and memorandum statement of other co-accused Farookh Rangrej and Jaspal. It appears that the applicant is the bonafide purchaser of the motorcyle for consideration. Taking into role played by the applicant, charge sheet has been filed and also for the fact that seizure has already been made, this court is inclined to release the applicant on bail. 6.
Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
