This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No. 24 of 2015 registered at Police Station- Purani Basti, Raipur (C.G.) for the offence punishable under Sections 420, 467, 468, 471/34 of IPC. 2.

As per prosecution case, the allegation against the present applicant is that on the basis of forged power of attorney the land of the complaint Smt. Kanchan Devi Chandrakar was sold by executing a sale deed in favour of co-accused Smt. Nisha Devi Tamrakar.

Taking into consideration the facts and circumstances of the case and the evidence which have come on record, this Court is of the view that prima facie case is made out for grant of bail to the applicant at this stage.

Accordingly, the bail application filed under Section 439 of Cr.P.C. is allowed and it is directed that the applicant shall be released on bail on furnishing a personal bond for a sum of Rs.25,000/- with one surety each in the like sum to the satisfaction of the concerned trial Court, for his appearance before the said Court.
