1. Heard on I.A. No.1/2021 joint application filed by counsel for the
applicants and counsel for respondent No. 1 for quashing of order passed by the Courts below on the basis of compromise.
2. Learned counsel for the applicants submits that this revision application has been filed against the judgment dated 02/07/2019 passed by the Sessions Judge, Janjgir, District Janjgir-Champa (C.G.) in Criminal Appeal No. 35/2019 (Sanjay Singh Chandel & Others vs. Smt. Kavita Singh @ Ranjita Singh & Others) and Criminal Appeal No. 42/2019 (Smt. Kavita Singh @ Ranjita Singh vs. Sanjay Singh Chandel & others) filed by non-applicant No.1, whereby the learned appellate Court has partly allowed both the appeals vide impugned order. Being aggrieved by the order dated 02/07/2019 passed in Criminal Appeal No. 35/2019 applicants have preferred this criminal revision but during pendency of this criminal revision, both the parties have entered into compromise and they have settled their dispute amicably which is basically matrimonial dispute, therefore, counsel for both the parties have jointly filed this application for quashing of impugned order in respect of this criminal revision.
3. Shri U.K.S. Chandel, learned counsel appearing on behalf of respondent No.1 Smt. Kavita Singh @ Ranjita Singh fully agreed with the submissions made by learned counsel for the applicants.
4. Affidavit of applicant Sanjay Singh Chandel and also photocopy of Ekrarnama (Samjhoutanama) executed between Sanjay Singh Chandel and Smt. Kavita Singh @ Ranjita Singh has also been enclosed with I.A. No.1/2021 in support of submissions made by both the counsel.
5. Considered the submissions.
6. As per the facts mentioned by both the counsel in I.A. No.1/2021 and also submissions made by them before the Court, since there had
been a matrimonial dispute between applicants and respondent No.1 Smt. Kavita Singh @ Ranjita Singh Chandel, pertaining to which they have entered into compromise and dispute has been settled amicably between them, therefore, I.A. No.1/2021 is allowed and on the basis of compromise arrived at between both the parties, impugned order dated 02/07/2019 passed by the Sessions Judge, District JanjgirChampa (C.G.) in Criminal Appeal No. 35/2019 and also order dated 08/03/2019 passed by the Judicial Magistrate First Class, Janjgir, District Janjgir-Champa (C.G.) in Criminal Case No. 120/2015 are quashed.
7. In view of the above facts, this criminal revision is allowed without considering on the merits of this revision.
