1. This is the second bail application moved by the applicant under Section 439 of the Code of Criminal Procedure, 1973 which was admitted for hearing in view of the filing of challan after rejection of his first bail application.

2. Heard Mr. Anumeh Shrivastava, learned counsel for the applicant and Mr. Ravi Bhagat, learned State counsel.

3. After hearing learned counsel for the parties at length and after going through the record, I do not consider it a fit case for admitting the applicant the privilege of regular bail in view of the quantity of charas i.e. 3.250 kgs recovered from the applicant which is more than commercial quantity in light of Section 37(1)(b) of the NDPS Act.
