Learned counsel for the petitioner submits that present petition may be disposed off with a direction to learned Family Court to decide the application filed by the petitioner under Section 25 of the Guardians and Wards Act which has been kept pending.

The present petition has been filed against the order dated 07-08-2020 passed in Case No.24/20 pending before the Family Court, Durg deciding the interim custody of the child in favour of the respondent. 3.

As the final order on custody of the child is yet to be passed by the Court concerned, therefore, on the basis of the submission made by learned counsel for the petitioner the present petition is disposed off at motion stage and learned Family Court is directed to expedite the proceeding and decide the application under Section 25 of the Guardians and Wards Act expeditiously preferably within a period of three months from the date this order is communicated.
