Hon'ble Shri Justice Sanjay K. Agrawal Order on Board 15/11/2016 1.
Limited grievance of the petitioner as ventilated through this petition is that despite existence of State Model Rehabilitation Policy, 2007 (Annexure P/2), providing for grant of employment in addition to payment of compensation upon acquisition of land, petitioner's claim
has remained pending with the respondents.
2.
After going through the contents made by the counsel for the petitioner in the petition and number of documents which have been placed on record, I find that the petitioner's claim is pending at various level but no final decision has been taken in the matter. 3.
Prima facie there exists policy of rehabilitation (Annexure P/2) wherein there is a provision for grant of employment subject to fulfillment of eligibility and terms of conditions enumerated therein. Therefore, the claim of the petitioner does not appear to be frivolous and requires consideration. Accordingly, the respondents are directed to expedite consideration and take appropriate decision with regard to the petitioner's claim for employment under the rehabilitation policy as early as possible preferably within a period of three months from the date of receipt of copy of this order. It is made clear that this Court has not expressed any opinion on merits of the case. 4.
In view of above, the petition stands disposed of. Sd/- (Sanjay K. Agrawal) JUDGE B/-
