The petitioner has made a compliant against the Rastriya Gaushala Trust, Dhamtari. The said complaint is pending before SDO(R), Dhamtari.

Admittedly, the petitioner is not a member of the Trust and has moved the complaint as a public spirited person, therefore, if the SDO(R), Dhamtari, is not proceeding ahead with the complaint, the petitioner has remedy of filing a suit under Section 92 of CPC. 4.

In view of the existence of alternative remedy, the writ petition is dismissed, as not maintainable, subject, however, to the liberty in favour of the petitioner to prefer a suit under Section 92 of CPC. Sd/- Judge (Prashant Kumar Mishra) Shyna
