Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 16/12/2020

1. The applicant has preferred this application for grant of anticipatory bail, as he apprehends his arrest in connection with Crime No.102/2013, registered at Police Station Frejarpur / Perpa, District : Kondagaon C.G. for offence punishable under Sections 363, 366 of the I.P.C.

2. Applicant abducted the prosecutrix, aged about 14 years and confined her in his house. The girl was recovered from the applicant's house on 08.06.2013 i.e., after two days of

MCRCA No. 1515 of 2020 the incident.

3. Learned State counsel would oppose the prayer for grant of anticipatory bail on submission that the applicant was arrested and was being brought to the Police Station, however, in the midway, he escaped from the Police custody.

4. Considering the nature of allegation, I am not inclined to extend the benefit of anticipatory bail.

5. Accordingly, the anticipatory bail is rejected. In the event applicant surrenders and moves the regular bail application, the jurisdictional Court shall consider and decide the same expeditiously.
