1. This Court by order dated 2.8.2018 directed counsel for respondent No.2 to seek instructions whether the admitted due of ₹ 85,97,243/- as stated in the return filed would be paid to the petitioner or not.
2. Learned counsel for respondent No.2, on instructions, would submit that respondent No.2 is ready and willing to pay in full and final settlement amount of ₹ 85,97,243/- to the petitioner.
3. Learned counsel for the petitioner submits that the petitioner is ready to accept the above-stated amount subject to liberty of raising the dispute before appropriate forum for balance due amount.
4. Since an amount of ₹ 85,97,243/- is admitted amount to be paid to the petitioner as stated in the return and by learned counsel for respondent No.2, it be paid to the petitioner. However, the petitioner is at liberty to raise the dispute as per law before appropriate forum for additional amount, if any.
5. With the aforesaid observation, the writ petition finally stands disposed of. No cost(s).
