Sam Koshy Order On Board 04/05/2017 The present application under Section 438 of Cr.P.C. has been filed seeking for grant of anticipatory bail to the applicant apprehending his arrest in connection with Crime No.126/2016 registered at P.S. Pandatarai, District Kabirdham (CG) for the offence punishable under Sections 294 & 506 of IPC and Section 3 (1) (x) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. After arguing for sometime, counsel for the applicant prays for withdrawal of this application. He, however, prays that the trial Court may be directed that in the event the applicant surrenders himself before the trial Court and moves an application for grant of regular bail, the same may be considered on the same day.
Accordingly, the instant application filed under Section 438 Cr.P.C. stands dismissed as withdrawn.
However, if the Applicant surrenders himself before the concerned Court below and moves an appropriate application for grant of regular bail, the same shall be decided by the said Court, if possible, on the same day on its own merits. Sd/- (P. Sam Koshy) Judge Bhola
