Petition under Article 226/227 of Constitution of India has
Page No.2 been brought by the petitioner praying for a direction to the respondent police authorities to register against Shivang Gupta, Alka Gupta & Swati Gupta being prime suspects for having committed murder of petitioners son. The petitioner has further prayed for constitution of a SIT to investigate the death of petitioners son and also for necessary action against the police personnels who have refused to register FIR against the aforementioned person.

It is submitted that son of the petitioner namely- Harshsaheb Gupta has committed suicide by consuming some poisonous substance leaving behind suicide note in which he has made specific allegation against his wife Shiwangi Gupta, his mother-inlaw Priyanka Gupta and sister-in-law Swati Gupta. The respondent authorities are not making fair investigation in the case and they are trying to protect the real culprits, therefore, a specific direction be issued to the respondent authorities to lodge FIR and to get the matter investigated by a specially constituted Investigation Team.

In reply, it is submitted by the counsel for State appearing for all the respondents, that FIR has been registered against the persons named in the suicidal note and the case is being investigated. Further, there is no requirement to constitute any SIT in this case. Petitioner himself may appear before the Investigating Officer and provide him information which are
Page No.3 available with him so that the case can be investigated in a fair manner.

Considering that the purpose of filing this petition has also been served as FIR has already been registered and the case is under investigation, no direction is further required to be issued. 5.
