This is an application under Section 438 of CrPC for grant of anticipatory bail to the applicant as he apprehends his arrest in connection with Crime No.406 of 2021 registered at Police Station Gandhinagar, Ambikapur, District- Surguja, Chhattisgarh for commission of offenses punishable under Sections 409, 420, 467, 468 and 471 of IPC.

Learned counsel for the applicant seeks permission of this Court for withdrawal of bail application and further submits that the applicant is aged about more than 60 years and retired employee, a direction be issued to the Court below to consider the application for grant of regular bail if filed by applicant upon surrender on same day. 3.
Learned State counsel submits that he has no objection for submission of learned counsel for the applicant.

In view of above, MCRCA- 1151 of 2021 is dismissed as withdrawn. 5.
If the applicant files an application for grant of regular bail after his surrender, the Court below concern, if possible may consider and decide it on the same day, in accordance with law.
