1. At the outset learned counsel for the applicant submits that Pulgaon police has filed charge sheet before the JMFC, Durg which is registered as Criminal Case No. 7198/2016. Instant MCRCA may be disposed of as withdrawn as the applicant intends to surrender before the trial Court. He prays that in the even of surrender of the applicant before the trial Court, the trial court may be directed to dispose of the application under Section 437 of the Cr.P.C., as expeditiously as possible.

2. As prayed, instant MCRCA is disposed of as withdrawn without appreciation on its merit. The trial Court is further directed to dispose of the application under Section 437 of the Cr.P.C. in the event of surrender of applicant before the trial Court in the matter, as expeditiously as possible.
